These Terms & Conditions set out the basis on which JF Groundworks provides access to this website, responds to enquiries, issues quotes and carries out work for customers.

They should be read alongside our Privacy Policy and Cookie Policy, which explain how personal information, cookies and website analytics are handled.

1. Who we are

JF Groundworks provides groundwork services across Kirkcudbright and Dumfries and Galloway, including drainage, excavation, site preparation, patios, landscaping support and general groundwork services.

2. Who these Terms apply to

These Terms apply to:

• visitors using our website

• people submitting general enquiries or quote requests

• customers who ask us to assess work and provide a quote and

• customers who accept a quote and instruct JF Groundworks to carry out work.

3. When these Terms apply

These Terms apply in different ways depending on how you interact with us:

• Website users accept these Terms by accessing and using the website

• Leads and enquirers accept the relevant parts of these Terms when submitting a contact form, quote request or other enquiry

• Customers accept these Terms when accepting a quote, instructing JF Groundworks to proceed, or otherwise confirming that work should begin

Where a quote, invoice or separate written agreement includes additional project-specific terms, those terms will also apply.

4. Website use

You may use this website only for lawful purposes and in a way that does not damage, disable, interfere with or misuse the website or its content.

You must not:

• knowingly submit false or misleading information

• attempt to gain unauthorised access to the website, hosting, connected services or data

• use the website for spam, abuse or unlawful activity or

• copy or reuse website content, branding or images without permission

We may update, suspend or remove website content at any time without notice.

5. Website content

We aim to keep website information accurate and up to date, but website content is provided for general information only and should not be treated as a final quotation, guarantee or formal advice.

Service descriptions, photographs, examples of work and equipment information are intended to give a general indication of the type of work we carry out. Final scope, pricing and timings will always depend on the individual project and quote.

6. Enquiries and quote requests

You may contact JF Groundworks using the website contact form, quote request form, phone or email.

When submitting an enquiry or quote request, you agree that:

• the information you provide is accurate to the best of your knowledge

• any uploaded photos, plans or documents are relevant to the enquiry

• you have the right to share the information you provide and

• we may contact you using the details you have supplied in order to respond to the enquiry

Submitting a form does not create a contract for work. A contract is formed only when a quote is accepted and JF Groundworks agrees to proceed.

7. Quotes

Quotes are provided free of charge unless otherwise agreed.

Unless stated otherwise in writing:

• quotes are valid for 14 days from the date issued

• quotes are based on the work scope discussed at the time of assessment

• quotes may change if material prices, fuel prices or other relevant costs change before the work is carried out

• any additional work requested after the quote has been issued will be treated separately and may change the final price and

• unless otherwise stated, quoted prices will include materials, waste removal and other third-party costs directly relevant to the agreed scope

If the scope changes, JF Groundworks reserves the right to revise the quote accordingly.

If the site condition changes after the quote is issued, or if the customer carries out or arranges other work that affects the site, the quote may need to be revised.

8. Consumer cancellation rights

If you are a domestic customer and your contract is made at a distance, such as by phone, email or online, or away from our business premises, you may have a legal right to cancel within 14 days.

If you ask us to begin work during the cancellation period, you may be required to pay for any work carried out before cancellation.

If work has been fully completed at your request during the cancellation period, you may lose the right to cancel once the work is complete, where permitted by law.

9. Scope of work

The scope of work is the work discussed, assessed and priced by JF Groundworks when the quote is prepared.

Any work outside that agreed scope will be treated as additional work and may result in additional charges.

Unforeseen site conditions may affect the scope, method, timing or cost of the work. This may include, for example:

• hidden obstructions

• unsuitable ground conditions

• drainage issues not visible at the time of quoting

• undisclosed underground services

• restricted access or

• third-party issues affecting the site

Where this happens, JF Groundworks will discuss the issue with the customer before proceeding with any material change where reasonably possible.

10. Customer responsibilities

Unless otherwise agreed in writing, the customer is responsible for:

• providing safe and suitable access to the site

• ensuring suitable parking, space for materials, waste, skips, machinery or equipment where required

• ensuring boundaries are confirmed where relevant

• disclosing any known underground services, utilities or access restrictions

• providing any available information about underground services, pipes, drains, cables, private water supplies, septic tanks, soakaways or other hidden features that may affect the work

• confirming whether any planning permission, building warrant, drainage approval, landlord consent, neighbour consent or other approval is required for the work, unless JF Groundworks has specifically agreed in writing to assist with this

• ensuring neighbouring or third-party issues are addressed where relevant and

• treating the site as a live work area at all times, with access limited to authorised persons only

Children, pets, vehicles and unauthorised persons must be kept clear of the work area while work is taking place.

11. Start dates, timings and delays

Any start dates or estimated completion times are discussed and agreed during the quote process based on the information available at the time.

All dates and times are estimates unless explicitly confirmed otherwise in writing.

Delays may arise due to matters outside our reasonable control, including:

• weather

• access restrictions

• material delays

• site condition issues

• hidden ground conditions or

• changes requested by the customer

JF Groundworks will make reasonable efforts to keep the customer informed where delays affect the agreed timetable.

JF Groundworks is not responsible for losses arising from reasonable delays or changes to estimated start or completion dates.

12. Rearrangements, cancellations and customer delays

Start dates may be rearranged by agreement with JF Groundworks.

If the customer wishes to cancel or postpone work:

• charges may apply where materials have already been ordered

• charges may apply where work has already started

• reasonable customer delays may be accommodated where possible but

• delays must not unreasonably disrupt other scheduled work or commitments

If the customer requests additional work after the quote has been accepted, that work must be agreed directly with JF Groundworks. Any related costs will be discussed and added to the final invoice where appropriate.

13. Pricing and additional charges

Any additional charges will only apply where justified by:

• agreed additional work

• changes to the agreed scope

• site conditions or issues not reasonably identified at quoting stage

• customer-caused delays or disruptions that materially affect the job or

• other circumstances specifically discussed and agreed with the customer

JF Groundworks will act reasonably and aim to keep the customer informed of any change affecting the price.

14. Payments and invoicing

Unless otherwise agreed:

• no deposit is required

• payment is due by the date stated on the invoice

• payment may be made by bank transfer or cash and

• staged payments may apply where previously agreed

JF Groundworks may request a deposit, staged payment or upfront payment for materials, plant hire, subcontracted services or larger projects.

For commercial customers, JF Groundworks reserves the right to claim statutory interest and reasonable debt recovery costs on late commercial payments, where applicable under late payment legislation.

For domestic customers, any follow-up action on overdue invoices will be handled reasonably and fairly.

15. Workmanship, materials and statutory rights

Nothing in these Terms affects your statutory rights.

JF Groundworks will carry out work with reasonable care and skill.

Where materials or products are used, any applicable manufacturer warranties remain subject to the manufacturer’s own terms and conditions. Copies may be provided where relevant and available.

JF Groundworks will review any workmanship concerns reported within a reasonable time after completion.

JF Groundworks will not be responsible for issues caused by:

• misuse

• lack of maintenance

• unauthorised alteration

• third-party interference

• normal wear and tear

• movement, weather conditions or site conditions outside our reasonable control or

• defects in materials supplied by others

Materials supplied by JF Groundworks remain the property of JF Groundworks until paid for in full, where legally permitted.

16. Photos and examples of work

JF Groundworks may take photographs of work during or after completion for records, quality checks, portfolio use or marketing.

We will avoid including personal information where possible.

If identifiable personal information, private property details or people are included, we will seek permission where required.

17. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any other liability that cannot legally be excluded or limited.

Subject to that:

• JF Groundworks will not be responsible for losses that were not reasonably foreseeable

• JF Groundworks will not be responsible for delay or failure caused by matters outside its reasonable control

• JF Groundworks will not be responsible for issues caused by inaccurate information supplied by the customer and

• liability will be limited to losses directly connected to the agreed work or website use, so far as legally permitted

18. Complaints

If you have a complaint or concern, please contact JF Groundworks using the details on our Contact Us page.

Issues should be reported as soon as they arise, within reason, so they can be reviewed promptly.

JF Groundworks will respond using the same contact channel where appropriate and will do its utmost to review and resolve issues fairly and reasonably.

These Terms should be read alongside:

• our Privacy Policy, which explains how personal information is handled and

• our Cookie Policy, which explains how cookies, analytics and similar technologies are used

20. Third-party links and external services

This website may contain links to external websites or use third-party services.

JF Groundworks is not responsible for the content, terms or privacy practices of third-party websites or services.

21. Changes to these Terms

JF Groundworks may update these Terms from time to time.

The latest version will be published on this page with the updated effective date.

22. Governing law

These Terms are governed by the law of Scotland, and any disputes will be subject to the jurisdiction of the Scottish courts, unless applicable consumer law provides otherwise.
